Due to Covid-19, this year’s EPIP conference took place online in a reduced format.

  • PLENARY SESSIONS

    • PLENARY SESSION “AI & Data Privacy” - ChairKeith Maskus, University of Colorado Boulder —— ParticipantsAlessandra Cincotti, Les Laboratoires Servier / Christophe Geiger, University of Strasbourg / Daniel Gervais, Vanderbilt / Tobias Salz, MIT
    >>> The panel features current legal and economic research in the areas of artificial intelligence, including regulation through both IP regimes and broader considerations, and cross-border regulatory conflicts and cooperation in the protection of data privacy.

    • PLENARY SESSION “Platform Regulation and the EU Digital Single Market” - ChairMartin Kretschmer, CREATe, University of Glasgow —— Participants: Natali Helberger, University of Amsterdam / Jeanette Hofmann, Wissenschaftszentrum Berlin / Pamela Samuelson, University of California, Berkeley / Philip Schlesinger, University of Glasgow / Sebastian Schwemer, University of Copenhagen
    >>> The dominant liability regime for platform intermediaries is about to change. The EU appears to be moving from an obligation to act upon knowledge obtained (“safe harbour”) to an obligation to prevent “online harm”. A multidisciplinary panel explores what this means for intellectual property law in the context of the global agenda on platform regulation (fake news, security, child protection, market dominance, data sovereignty).

    • PLENARY SESSION “Law and Economics of Trade Secrets” - Chair: Nari Lee, Hanken School of Economics —— Participants: Marco Alemán, World Intellectual Property Organization / Tanya Aplin, King’s College, London / Sharon Sandeen, Mitchell Hamline School of Law / Nicola Searle, Goldsmiths, University of London
    >>> With growing importance of trade secret on innovation, this multidisciplinary panel explores how key concepts of trade secret, such as ‘value’, are understood by legal and economic researchers and whether there are any essential disparities, and how policy makers make concrete decisions based on research.

    • PLENARY SESSION “Covid-19, Innovation and IP” - Chair:  Catalina Martinez, CSIC Institute of Public Goods and Policies —— Participants:  Lisa Ouellette, Stanford Law School / Joshua S. Gans, University of Toronto / Chirantan Chatterjee, Hoover Institution, Stanford University & IIM Ahmedabad / Philippe Gorry, GREThA CNRS 5113 & Health Sciences College, University of Bordeaux

    • PLENARY SESSION “Chief Economists Roundtable: Covid-19 and IP Offices” - Chair: Stefan Bechtold, ETH Zurich —— Participants: Carsten Fink, World Intellectual Property Organization / Yann Ménière, European Patent Office / Andrew Toole, U.S. Patent & Trademark Office / Nathan Wajsman, European Union Intellectual Property Office
    >>> In this traditional EPIP roundtable, chief economists of important IP offices discuss the implications of Covid-19 on IP offices.

    • PLENARY SESSION “Brands & Boundaries: Overlapping Trademarks and Other IP Rights?”Chair: Amanda Myers, Booz Allen Hamilton —— Participants: Irene Calboli, Texas A&M University / Estelle Derclaye, University of Nottingham / Marcus Höpperger, WIPO / Eleonora Rosati, University of Stockholm
    >>> This session focuses on the phenomenon of overlapping rights, in particular the overlaps between trademark, design, and copyright protection. IP overlaps have long been used in legal practice. Trademark protection, in particular, is often sought due to the additional length that trademark rights grant. However, courts have at times supported and other times pushed back against these overlaps on the basis of concerns about competition and freedom of expression. In this session, panelists and commentators address and critically review recent developments, trends of registrations in IP offices, and judicial decisions in this area.
